Welcome to Wight Market, the Isle of Wight’s online marketplace for makers, creators and local shoppers. By using our website, whether you’re browsing, buying or selling, you agree to follow these Terms & Conditions. We’ve kept them clear and straightforward, so you know exactly where you stand.

Accepting these terms

By accessing or using Wight Market, you are agreeing to these Terms. If you don’t agree, we kindly ask that you stop using the site. These Terms form a simple contract between you and Wight Market to ensure everything runs smoothly and fairly.

Your account

To open a seller account, you must be 18 or over. Buyers under 18 may use the site, but only with the supervision and permission of a parent or guardian. You are responsible for keeping your account details safe and for all activity that takes place under your login. We expect honesty from our users, so please don’t provide false details or impersonate someone else.

What you can sell

Wight Market exists to celebrate local creativity and handmade goods. You may list items that are handmade, designed by you, vintage (where accurately described), or thoughtfully curated craft supplies. You must have the rights to sell what you list and you’re responsible for ensuring your items comply with UK law, product safety rules, labelling requirements, and any required UKCA/CE markings or registrations.

To keep the marketplace safe and community-minded, certain things aren’t allowed. Obvious examples include illegal items; counterfeit or trademark-infringing goods; stolen property; dangerous or hazardous materials (including explosives, fireworks, corrosives and toxic chemicals); weapons and realistic replicas; drugs and drug paraphernalia; prescription-only medicines and most medical devices; alcohol, tobacco and vaping products; adult content that is explicit or pornographic; hate or extremist materials; items made from endangered species or otherwise breaching wildlife regulations; surveillance/spyware or devices designed to secretly record; recalled items; and anything that promotes harm or is reasonably likely to cause injury. Food and cosmetics may only be listed if they fully comply with applicable UK safety, hygiene and labelling laws; if you’re unsure, please do not list them. Live animals are not permitted. If in doubt about an item’s suitability, contact us before listing.

Your content

Anything you upload such as photographs, product descriptions, or shop information remains your property. However, by posting it on Wight Market, you give us permission to display it on the site and to use it in reasonable promotional materials, including our social channels and newsletters. We will always respect your rights, but we ask that you only post content that is accurate, respectful and does not infringe anyone else’s rights.

Buying and selling

Transactions on Wight Market are made directly between buyers and sellers. We provide the platform, but we do not manufacture, store, inspect, package, or ship items. Sellers are responsible for their own shops, listings, prices, delivery timescales, returns policies and taxes. Buyers should read listings carefully and contact sellers with any questions before purchasing.

Orders, delivery, returns and disputes

If something goes wrong with an order, your contract is with the seller, not Wight Market. If an item arrives damaged, is not as described, is missing parts, or fails to arrive, please contact the seller through Wight Market messages as soon as possible, ideally within 14 days of delivery (or expected delivery) with clear details and any supporting photos. Most issues can be resolved directly, through a replacement, repair, resend, or refund, according to the seller’s stated policy and your statutory rights under UK consumer law.

Sellers are responsible for providing accurate descriptions, safe packaging, timely dispatch, valid tracking where offered, and fair returns/cancellation terms. Buyers are responsible for providing correct delivery details, being available to receive the parcel, and following any return instructions provided by the seller. If a parcel is returned due to an incorrect address or failure to collect, additional delivery charges may apply at the seller’s discretion.

Wight Market is not a party to the contract of sale and does not hold buyer funds. We do not guarantee delivery dates, item quality, conformity, or outcomes of disputes. While we may, at our discretion, offer guidance or limited assistance through the platform, we are not responsible for issuing refunds or enforcing performance and we are not liable for losses arising from orders, delays, damage in transit, items not as described, non-delivery, or disagreements between members. If you cannot reach a resolution directly, you may seek advice from your payment provider (for example, where chargeback rights apply) or pursue your legal remedies.

Fees

From time to time, we may charge listing fees or take a commission from sales. Any fees will always be made clear before you list an item. Sellers are responsible for any applicable taxes relating to their sales.

Using the site

We ask that everyone uses Wight Market respectfully. This means no abusive behaviour, spamming, intellectual-property violations, or attempts to damage or disrupt the site. The marketplace must not be used for any unlawful activity. If these rules are broken, we may remove content or suspend accounts where necessary to protect the community.

Termination

You can close your Wight Market account at any time. Likewise, we may suspend or close accounts that break these Terms, or where we are required to do so for legal or safety reasons. Closing an account won’t affect the availability of content you posted prior to closure if it has already been shared or cached.

Warranties and liability

Wight Market is provided “as is.” We work hard to provide a reliable service, but we cannot promise it will always be available or error-free. We are not responsible for the quality, safety, legality, or accuracy of items listed by sellers, nor for disputes between buyers and sellers. To the fullest extent permitted by law, Wight Market (and its owners and team) will not be liable for lost profits, lost data, loss of goodwill, or any indirect, incidental or consequential damages arising from use of the site or marketplace transactions.

Disputes and governing law

If you have a dispute with another member, please try to resolve it directly first. If that isn’t possible, you can contact us and we’ll do what we reasonably can to support you, without taking on responsibility for the outcome. These Terms and any non-consumer disputes are governed by the laws of England and Wales, and the courts of England and Wales will have exclusive jurisdiction. If you are a consumer, you may be entitled to bring claims in your local UK court.

Changes to these terms

We may update these Terms from time to time. If we make important changes, we will notify you by email or via a notice on the site. By continuing to use Wight Market after changes are made, you accept the updated Terms.
